Oklahoma’s Probate Laws can be difficult to navigate and can result in families unnecessarily spending too much time and money on administration of a small estate. Summary Administration is a process available to certain estates that results in less time in court and less money spent on attorneys.
Summary Administration is found in Title 58 Section 245 of the Oklahoma Statutes. A petition for Summary Administration can be filed by any person interested in an estate that meets on of the following:
- Value of the estate is less than or equal to $200,000.00;
- Decedent has been deceased for more than five (5) years; or
- Decedent resided in another jurisdiction at time of death.
Under certain circumstances, this process allows for the appointment of the estate’s administrator without having a hearing. In practice, this can often mean that no court appearance by the party will be necessary at all.
