Who Can File & When: Oklahoma Lien Deadlines
Oklahoma law grants lien rights to anyone who furnishes labor, materials, or equipment to improve real property under a contract with the owner or with the owner’s contractor or subcontractor. That broad category includes framers, roofers, concrete suppliers, HVAC installers, architects, engineers, and surveyors, provided their services directly contribute to the project.
The filing windows depend on your role:
- Original contractors must file a lien statement within four months of last furnishing labor or materials on the project
- Subcontractors and suppliers must file within 90 days after last furnishing labor or materials under their subcontract
- Pre-lien notice requirement generally applies to subcontractors and suppliers without a direct contract with the property owner; they typically must send a Notice to Owner within 75 days of last furnishing labor or materials, informing the owner of their contribution to the project (exceptions can apply for smaller claims and certain residential projects)
Missing the applicable deadline forfeits your lien rights under Oklahoma law. The underlying debt doesn’t disappear, but you’d be limited to pursuing it through a breach of contract lawsuit rather than a secured lien claim against the property.
Filing a Valid Lien Statement in Oklahoma
A lien statement must include the amount claimed, an itemized description of the claim, the names of the property owner, contractor, and claimant, and a legal description of the property. It must be verified by affidavit and filed with the county clerk where the property is located. For Norman projects, that means the Cleveland County Clerk.
Once filed, the lien is enforceable for one year from the filing date. If no foreclosure lawsuit is initiated within that year, the lien expires and loses its force. A property owner who wants to clear title during that period can post a bond, typically set at 125% of the claimed amount, to discharge the lien while the underlying dispute continues. Oklahoma law also allows a prevailing lien claimant to recover reasonable attorney fees incurred in enforcing the lien, which can make pursuing a valid claim financially practical even on mid-sized projects.
